GAS SHUT OFF VALVE

If you own a home in the unincorporated areas of the County of Contra Costa, there is a Point of Sale Ordinance requiring property sold to have an automatic gas shut off valve (FAQ's). The county has a special program discounting the permit fee (now only $62.25 and is required!) There are several good plumbing and heating companies around who are familiar with this ordinance. I have made arrangements for many owners who are considering selling or have sold their home. My thinking -why wait? Whichever earthquake fault your home is on, this is a means of protecting your home from a fire due to a gas line breaking.

PURCHASE CONTRACT INFORMATION

A note for buyers and sellers regarding the removal of contingencies as provided for in the purchase contract. A recent article in our Real Estate Magazine is one for everyone to read. Briefly it states when a buyer has a period to remove contingencies and doesn't, the buyer's contingencies do not automatically expire. "The buyer retains the right to cancel as long as the buyer's contingencies have not been removed in writing." So what is the hurry? The Seller can then notice the buyer with a 24 hour notice to perform - which has given the buyer some breathing room to make their decision. Once the notice by the seller has been given to the buyer, the buyer must then act. By the way - Buyers are expected to act honestly and in good faith. The contract does not require the buyer to state a reason for cancelling.

And a common mistake made by sellers and listing agents pertains to a buyer's request for repairs. This article explains "before agreeing to do repairs, a seller should consider requiring the buyer to remove any contingencies. Otherwise the seller may incur the cost of repairs, yet may not be entitled to the deposit or to any reimbursement should the buyer subsequently cancel.
